This section represents
news that may affect North Carolina residents especially pertaining
to the Lemon Laws. Please check back often as we update the Lemon
Law news section frequently.
- According to an article in the Evening Sun, McSherrystown Borough,
Pennsylvania officials cannot use the state's Lemon Law statute
to attain justice for a broken down police car. Apparently the
law only applies to private owners and not to municipalities.
- WASHINGTON, DC, United States (UPI) -- A possible fire-igniting
switch in more than 3.7 million Ford vehicles is under investigation
by the National Highway Traffic Safety Administration. Ford, which
has made two recalls related to the problem, says it is cooperating
in the investigation. The federal agency says it has received
559 complaints of spontaneous fires, 253 of them in unrecalled
models, and its latest investigation includes the 1995 model years
of the F-150, Expedition and Lincoln Navigator vehicles.
- PHILADELPHIA, June 2 -- David J. Gorberg, Esquire of the lemon
law firm of David J. Gorberg & Associates has been named,
for the second year in a row, as a 2005 Pennsylvania Super Lawyer.
In addition to the Super Lawyer award, Mr. Gorberg was also honored
for the second year in a row as one of the Top 100 Lawyers in
both Philadelphia and Pennsylvania in a recent study by Philadelphia
Magazine and Law & Politics Magazine. The Top 100 Lawyer List
and Super Lawyer List were published in the June 2005 edition
of Philadelphia Magazine and Law & Politics Magazine.
- Norman F. Taylor Esq. offers a book on the lemon laws. Filled
with practical information, "Lemon law - The Standard Reference
Guide," ISBN 0-9760058-0-8 is a tool for laymen and legal
professionals alike. Taylor's second book on the subject exposes
all the dirty tricks manufacturers and dealers employ to get the
consumer to give up and go away. Every aspect of this important
consumer subject is examined. Thousands of new lemon cars and
motor homes are sold every year. This carefully written book evens
the playing field when consumers must take on manufacturers to
exercise their rights.
- In Oklahoma, A proposal to strengthen protections for Oklahoma
car buyers has failed in that state's legislature after pressure
from General Motor and other automakers. The lemon law passed
the House and Senate by wide margins before being sent to a House-Senate
conference committee, where it died. The bill would have given
buyers of repeatedly defective vehicles the option of taking a
full refund or a replacement vehicle of a similar type. Current
law allows the manufacturer to mandate those terms to the consumer.
- (Grand Rapids, May 26, 2005, 8:40 a.m.) Every year, the Target
8 tipline receives dozens of horror stories involving used cars
breaking down just days after they roll off the lot. So, what
are a consumers' rights when a used car, sold "as is,"
turns out to be clunker? What does the Michigan Independent Automobile
Dealers Association think about this used car lemon law? We got
a "no comment." But when it comes to used car lemon
laws in general, MIADA President Ton Stehouwer says staffing certified
mechanics to perform bumper to bumper inspections on old cars
would only further inflate prices.
- MADISON, Wis. - A woman can proceed with a lawsuit alleging
a federal law entitles her warranty protection on her Volkswagen
even though she leased the car and doesn't own it, the state Supreme
Court ruled Friday. The Supreme Court's ruling upheld an appeals
court decision in the first legal fight in Wisconsin over whether
someone who leases a car has legal standing to enforce a warranty
under the federal lemon law. The decision means people who lease
cars statewide can bring lawsuits over warranty problems under
the federal law, said the woman's attorney, Scott Cohen.
